Policy

It is the policy of Minnesota State University Mankato to exercise due diligence in assessing materials or property being considered for use as part of a new or changing academic programing or university operations.  The due diligence required will be to fully understand the potential impact including cost, and other liabilities before introducing or accepting the materials or property.

Procedure

Prior to accepting any new materials or property through programmatic changes, donations, or other means, Minnesota State University Mankato’s Director of Environmental Health, Safety and Risk Management will review all materials, property and non-monetary donations and determine:

1. If the materials and/or property donation meets one of the following Minnesota Pollution Control Agency (MPCA) waste definitions, they will not be accepted. The specific definitions are:

A.Hazardous Waste: Any material, product, or substance that meets one of the following as defined by the MPCA:

i. It displays a hazardous waste characteristic as defined by the MPCA

ii. It is recorded in one of the four MPCA lists of hazardous waste

      • Ignitable (I)
      • Reactive (R)
      • Toxic (T)
      • Acutely Hazardous (H)

iii. It contains polychlorinated biphenyls (PCBs)

B. Universal Waste: A subset of hazardous waste that is managed under reduced requirements.  These wastes are referred to as universal because almost every business, non-profit organization and government agency generates them.

C. Infectious/Biological Waste: Wastes that poses a biological risk.  Examples include; blood and other body fluids, sharps, human vaccines, infectious cultures, etc.

2. If the acceptance of the donation will create a significant impact on existing waste streams, create a new waste stream, and/or the acceptance impacts the campus waste generator size. From this analysis, the benefit of accepting the donation, versus the cost for disposal, will be determined.  If accepted, any extra cost for disposal or impact to the university’s MPCA waste generator size will be assigned to the requesting college/division and its responsible department(s).

3. If new campus programs or current program changes will create a major impact on existing waste streams, create a new waste stream, and/or impacts on the campus waste generator size as determined by the Director of Environmental Health, Safety and Risk Management; from this analysis, the cost for disposal will be determined and any extra cost for disposal or impact to the university’s MPCA waste generator size will be assigned to the requesting college/division and its responsible department(s).

Rationale

This policy has been developed in strict accordance with agreements outlined in the 13, June 2012 Stipulation Agreement executed upon between the Minnesota Pollution Control Agency (MPCA) and Minnesota State Colleges and Universities (MnSCU).  This policy specifically addresses Stipulation Agreement citations Minn. R. 7001.0520 Permit Requirements subpart 1 and Minn. R. 7045.0665 Subpart 1.
