Minnesota Office of Higher Education Sexual Assault Data Report

Minn. Stat. § 135A.15, subd. 6 requires postsecondary institutions to annually report statistics on sexual assault to the Office of Higher Education (OHE). See the OHE Sexual Assault Data Reporting Manual.

For the purpose of this report sexual assault is defined as "rape, sex offenses – fondling, sex offenses – incest, or sex offenses – statutory rape as defined in Code of Federal Regulations, title 34, part 668, subpart D, appendix A, as amended." Minn. Stat. § 135A.15, subd. 19. The following are definitions of those terms:

"Rape – The Penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ or another person, without the consent of the victim. . .

Sex Offenses – Any sexual act directed against another person, without the consent of the victim, including instances where the victim is incapable of giving consent.

A. Fondling – The touching of the private body parts of another person for the purpose of sexual gratification, without the consent of the victim, including instances where the victim is incapable of giving consent because of his/her age or because of his/her temporary or permanent mental incapacity.

B. Incest – Sexual intercourse between persons who are related to each other within the degrees wherein marriage is prohibited by law.

C. Statutory Rape – Sexual intercourse with a person who is under the statutory age of consent."

Reports are submitted to the Office of Higher Education in October for the previous calendar year. For example, the report for the 2022 calendar year was submitted on October 1, 2023. The public report includes the display of "<10", suppressing data to protect student identity.
