What does Age protected class status mean?
According to the Equal Employment Opportunity Commission, “the Age Discrimination in Employment Act (ADEA) forbids age discrimination against people who are 40 or older. It does not protect workers under the age of 40, although some states have laws that protect younger workers from age discrimination.” *
In Minnesota, “the Minnesota Human Rights Act protects employees who are 18 and older from age discrimination.” ** The Act does include a provision that if age is a “bona fide occupational qualification (BFOQ) for the job in question”*** then there is no discrimination.
